Please read these terms carefully before using the Worksy platform. By accessing or using our app or website, you agree to be bound by these terms.
Worksy is a South African technology platform ("Worksy", "we", "us", or "our") that operates a digital marketplace connecting homeowners and individuals ("Clients") with independent third-party service professionals ("Service Providers"). We operate through our website and mobile application (collectively, the "Platform").
These Terms of Use ("Terms") govern your access to and use of the Platform. By creating an account or using any part of our service, you confirm that you have read, understood, and agree to these Terms in full.
Worksy is a marketplace and technology connector. We are not a service provider, contractor, or employer of any Service Provider listed on our platform.
Worksy's role is strictly limited to:
All Service Providers on the Worksy platform are independent contractors. They are not employees, agents, partners, or representatives of Worksy. Worksy does not direct, supervise, or control the manner in which any service is performed.
The contract for the provision of services is formed directly between the Client and the Service Provider. Worksy is not a party to that contract.

You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You agree to notify us immediately at info@worksy.co.za if you suspect any unauthorised use of your account.
Worksy reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in behaviour that is harmful to other users or the Platform.
When you book a Service Provider through Worksy, you acknowledge and agree that:
Worksy makes reasonable efforts to verify Service Providers but cannot guarantee that all information provided by Service Providers is accurate or that their work will meet your expectations. Verification is a good-faith measure and does not constitute a warranty or endorsement of any Service Provider's work.
As a Service Provider on the Worksy Platform, you agree that:
Worksy reserves the right to suspend or permanently remove any Service Provider from the Platform at its sole discretion, including for poor performance, complaints, or violations of these Terms.
All payments for services are processed through the Worksy Platform. Client payments are held and only released to the Service Provider upon confirmation that the job has been completed to the Client's satisfaction.
Worksy charges a platform fee on transactions to support the operation of the service. This fee is disclosed transparently at the point of checkout.
In the event of a dispute regarding payment, Worksy may assist in mediation but is not obligated to issue refunds except in circumstances where we determine, at our sole discretion, that a refund is warranted (for example, where a confirmed booking is not fulfilled by the Service Provider).
Worksy is not responsible for any losses arising from payment disputes between Clients and Service Providers that fall outside the direct booking process.

To the fullest extent permitted by applicable South African law, Worksy expressly disclaims all liability for:
Worksy does not carry insurance on behalf of Service Providers or Clients. Service Providers are solely responsible for maintaining any insurance or indemnity cover required for their trade. Clients engage Service Providers at their own risk.
In no event shall Worksy's total liability to any user exceed the total platform fees paid by that user to Worksy in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.
Worksy provides a basic dispute resolution channel to help Clients and Service Providers reach a resolution for issues arising from bookings made on our Platform. We will make reasonable efforts to facilitate communication between parties.
However, Worksy is not a court, arbitrator, or legal authority. Our involvement in any dispute is offered as a goodwill service and does not create any legal obligation on Worksy to resolve, adjudicate, or compensate for the outcome of any dispute.
Disputes that cannot be resolved through our support process must be settled directly between the Client and the Service Provider through appropriate legal channels under South African law.
By using the Platform, you agree to attempt to resolve disputes with other users in good faith before pursuing legal action.

Violation of these provisions may result in immediate account suspension or permanent removal from the Platform, and may be reported to appropriate law enforcement authorities.
You may close your Worksy account at any time by contacting us at info@worksy.co.za.
Worksy reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, posed a risk to other users, or for any other reason at our sole discretion.
Upon termination, your right to use the Platform ceases immediately. Outstanding payment obligations remain enforceable after termination.
Worksy may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will attempt to notify registered users via email or in-app notification.
Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
